Revised Internal Rules for the Residents Association. Iria V (modified at the AGM 04-02-2025)

Art.1. All property owners and occupiers will not disturb other residents. All equipment (radio, television power tools etc.) are to be used in such a way as to not cause a disturbance to other residents. Please respect others and keep noise to a minimum after 24.00hrs., including dog barking.

Art.2. All occupants will maintain the urbanisation in a clean and tidy manner and are requested not to drop any litter.

Art.3. All gates to be kept closed and always locked.

Art.4. Parents must ensure that their children lock the gates all time.

Art.5. Parents/guardians are responsible for the actions and safety of the children in their care within the urbanisation at all times.

Art.6. The driving of vehicles within the urbanization is limited to 10 km/h. It is not permitted to park any vehicles on the urbanization roadways except for loading/unloading. All visitors should observe these rules.

Art.7. No cycling or skating allowed in passageways. Art.8. No ball games allowed on the urbanisation.

Art.9. Dogs should be kept on leads and under control on the paths and internal roads of the urbanisation, at all times. Any excrement must be cleared by owners immediately.

Art.10. Property owners are requested to maintain their properties and gardens in good condition thereby maintaining a high standard throughout the urbanisation.

Art.11. If any owner`s garden/terrace needs cleaning/tidying and is not attended to upon request by the management committee, the community will arrange for the works and add the costs to the owner`s community fee account.

Art.12. In the case that a property is let to friends or rented, the owner is obligated to ensure the occupants are made aware of these rules. If there are problems with paying clients and the owner does not respond to the comments of the President, then the owner will be reported to the local authority to ensure that the property is being let legally, and taxes being paid to the Spanish authorities.

Art.12.1. It was decided at the AGM held on 4th February 2025 that the community does not allow owners to have a Tourist License. If you already have a Tourist License, it may be used until the expiry date, but the Community does not approve of any renewal of it.

Arti.12.2. It was decided at the AGM held on 4th February 2025 that owners who have a Tourist License must pay an additional 20% of the Community Fee, until the License expires.

Art.13. Owners or their guests who continuously break community rules shall after breaking the rules 3 times have a penalty of €50 added to the owner’s debt. Complaint forms for owners to fill in regarding the rule breaking can be obtained from committee members or on the community website.

Art.14. COMMUNITY FEES – (please refer to the last set of minutes for amounts due and payment periods).

Please be advised of the following agreements adopted by the community of owners, for unpaid fees:

 

  • On March 1st and September 1st, a 18% surcharge will be added to the outstanding fee. Returned direct debits incur a charge of €10. As agreed at previous AGM.
  • If the fees are not paid by April 1st and October 1st a registered letter will be sent to the owner with a 300€ fine. (150€ of this fine goes to the community and 150€ to the administrator to cover the costs). As agreed at previous AGM.
  • If the fees and penalties are still not paid, the community will take legal actions. As agreed at previous

The President has also been empowered to grant as broad powers of attorney as are appropriate in law to lawyers and/or solicitors to take legal action against them. The President and/or administrator has the exclusive right to choose the jurisdiction to take legal action either in Spain or in the countries of international domicile/domicile of the debtor, including England, Scotland, Ireland, Northern Ireland or Wales, and to use such powers as exist in Law for Lawyers and/or Solicitors to proceed to take legal action against the same. Additionally, the President is empowered to authorise litigation as deemed necessary in the pursuit of debts owed to the community.

Art.15. ACCORDING TO OUR DEEDS, ALL COLOURS MUST BE IN KEEPING WITH THE ORIGINAL COLOUR SCHEME.

 

(i)   CHINA FINISH ON FACADES

If owners’ re-china the exteriors, it must be the same colour finish as was original when the community was constituted, forgiving only minor variations due to the mix. It must be accepted that the china will stand approximately one centimetre proud.

Owners must cover a whole section/panel of their property, to appear visually/aesthetically pleasing to the eye.

 

(ii)   PAINTING OVER THE CHINA FACADES

Owners must adhere to the SAME colour of paint, to conform to the deeds.

The closest colour of the main part of properties is called ALABASTRO. The code is 416 and can be purchased at the local ferreteria. The brand is REVESTIMIENTO FACHADAS

The mustard/sand colour border, below the roof tiles, is called ALBERO INTENSO (code: 2100 167)

Owners must paint the whole section/panel of their property, to appear visually/aesthetically pleasing to the eye.

 

IF ANY OWNER IS IN ANY DOUBT AS TO WHAT A SECTION MEANS, PLEASE SPEAK TO THE PRESIDENT/COMMITTEE MEMBER.

Painting, re-painting or the re-china of property facades DO NOT require approval if the above criteria are met.
